The 3rd AML Directive was transposed into Irish law on 5 May 2010. It is expected that the new Criminal Justice (Money Laundering & Terrorist Financing) Act 2010 will be implemented on and from 15 July 2010.
This advanced-level practical course, delivered by Irish based internationally experienced anti-money laundering consultants, including a former FSA regulator and lawyer, will review the latest amendments to Ireland's anti-money laundering laws and Guidance Notes, as well as the practical effect of the 3rd EU AML Directive on your business. Examining:
- the new 2010 Act;
- the Sanctions Lists requirements;
- the Guidance Notes;
- the FATF 40 recommendations and 9 special recommendations;
- Financial Regulator's recent anti-money laundering directions;
- the 3rd EU Money Laundering Directive, and
- implementing the risk-based approach at client, firm, transaction and geography levels

The anti-money laundering and financing terrorism obligations imposed upon solicitors, especially the requirement to report suspicious activity, is a very topical issue facing Irish legal practitioners.
OBJECTIVES:
The course examines the relevant parts of the Criminal Justice (Money Laundering & Terrorist Financing) Act 2010 and publicly available Guidance issued by the Law Society of Ireland and also the Core guidance for the other designated persons to explain, in practical terms, the key financial crime issues, in particular:
- Your legal obligations as solicitors - under the Act;
- The steps to take to meet your obligations - determining what is satisfactory evidence of identity for different types of natural and legal persons, exemptions, introduction certificates, initial and ongoing CDD responsibilities, record-keeping, how to evidence your compliance with the legislation; and
- Problems faced by solicitors - identifying & reporting suspicious activity, confidentiality & privilege, what to do after a report has been made, the "tipping-off" offence, civil liability & instances where solicitors (and others) have been prosecuted for failing to report suspicious activity.
